The Colorado Supreme Court hands down a bombshell decision

As you may have heard, the Colorado Supreme Court ruled late Tuesday that the authoritarian-curious frontrunner for the GOP presidential nomination is disqualified from appearing on the state’s presidential primary ballot next year. The court ruled in a 4-3 decision that Trump is ineligible to appear on the ballot because he violated Section 3 of the 14th Amendment, which states that no person shall “hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion” against the United States. It’s a courageous decision and one that appears at first glance to be legally sound. It’s also a decision the Supreme Court will be forced to address for the simple fact that not weighing in prior to the election (and the primaries) would leave the country in a sort of legal/constitutional limbo. The Colorado high court accounted for this likelihood, saying the decision would not take effect until January 4th, giving SCOTUS time to weigh in. I’ll have more to say on the issue, including a deeper legal analysis, in the maiden voyage of the Weekly Newsletter in a few days. And yes, I miss all of you, too.
